Vehicle Insurance Claim

I received a text message the other night from the secretary of a company that buys vehicles through me every year. One of their dealers - recipient of their car incentive plan, had a vehicular accident that night. Fortunately, no one was hurt only damages to the vehicle was sustained in the accident. They did not have their insurance policy in the Isuzu Crosswind so they did not know what to do.

Most comprehensive vehicle insurances are enrolled with a 24-Hour Road Assistance Service (towing). But the emergency numbers are in your policies and the operators will ask you for your policy details - like name, address, policy number etc so it is important to have a copy of your comprehensive vehicle insurance policy in your automobile.

Anyway, there was a tow truck available at the accident scene so I advised the secretary to inform them to advance the payment for the tow truck. Ask for a Official Receipt of payment as they will be needing this for their reimbursement of the towing fee as stipulated in the policy.

Other documents needed for their insurance claim (OWN DAMAGE) are -
1) Copy of insurance policy
2) Police Report
3) Driver's License with Official Receipt
3) Copy of automobile LTO OR CR
4) Pictures of the damage/s with the LTO plates of the vehicle visible
5) Stencil of the engine and chassis number
6) Repair Estimate - which in this case would be supplied by the authorized Isuzu Dealer

If there is a Third Party Claim on your vehicle insurance, the third party must submit all of the above documents plus -

1) Certificate of No Claim from their vehicle insurance company to rule out double claims

In a OWN DAMAGE claim the insurance policy owner will shoulder a certain amount (known as the Deductible or Client's Participation). This amount is stipulated in the insurance policy and is usually either 1% or .5% of the amount insured. Expenses Over and above the Deductible amount is shouldered by the insurance company.

For THIRD PARTY claims on the comprehensive vehicle insurance policy, the policy owner does not pay any deductible amount.

Not all damages are covered by your regular comprehensive insurance these instances are -
1) when the driver of the vehicle is performing a illegal act that resulted in the accident -
ex. drunken driving, passing through a red light etc.
2) Force Majeure or Acts of God - accidents or damages due to acts of nature - typhoon,
hurricane, flood etc. (however, for a additional insurance premium damages caused by
Force Majeure / Acts of God maybe included in your insurance coverage)
3) Riots, War, public disturbances - if damage to your vehicle is a result of war, riots,
public disturbances and uprisings

Two  of the Frequently Asked Questions [For Own Damage Claims]  on this blog are
1)  Can the damage done to my vehicle be claimed with my insurance?
     Answer:   Please check your insurance policy.  Look for the Deductible amount.
                      If repair estimate of your car's damage is beyond your deductible/participation amount
                      then you can file for an insurance claim.
     Suggestion:  If the participation ratio between you and your insurance is such that you have
                      the bigger part, it would be practical for you to have the damage repaired on your own.
                      Example:    Your deductible is P6,000 - estimated repair for your unit is P7,000 which
                                          means since your share is P6,000 and the insurance share is only P1,000
                                          it would practical for you to just have your unit repaired on your own.
2)  My vehicle is more than 3 years old, I had an accident with damage that require replacement of
     damage parts.   How much is my participation on the depreciation?
     Answer:  Please check your insurance policy.  They have a table of depreciation showing your
                     percentage share.  Compute the % against the cost of the replacement part, the result is
                     your share.
     Suggestion:  If your vehicle is more than 5 yrs old and you want to cut down on the costs of your
                     expense participation, you can avail of the insurance company's accredited A1 Auto
                     Repair Shops.
3) Note:  Your deductible/participation is based on per Own Damage claim.

Most of us who have a Comprehensive Auto Insurance policy seldom read through them.  It is a common trait among us.  Unfortunately, vehicular accidents do happen and when it does, we are most often flabbergasted and at a loss as to what to do.
What do we do when we figure in a car accident?
1)  First of all, it is always handy to have a copy of your car insurance policy in your vehicle.
2)  Regardless of who is at fault, one must always keep a cool head.  Heated arguments lead nowhere.
3)  Fortunately, everyone has a cellphone with picture-taking capabilities nowadays.  Take a picture of      the accident scene & damage – close-up, front, side and rear angle view (slightly afar from the scene).

4)  Options:  depending on the gravity of the accident
      a)  wait for a traffic enforcer to approach / arrive
      b)  call the appropriate hotline below  to report the traffic accident

5)     Get to know the other party.  Most importantly, is his vehicle covered by a comprehensive insurance policy or just a Compulsory Third Party Liability?  It is the moral obligation for the party at fault to shoulder the repair expense for the damage incurred by the accident. Having a comprehensive insurance coverage is very important for both.

6)       At the police station
 a)   The police investigator will require the Driver’s License of parties involved in the accident
 b)   He will hand over to each party the Traffic Accident Situation Form where each party is required to narrate their version of the incident.
 c)   From the narration of each party involved, a sketch will be drawn up of the accident indicating
                the position of each vehicle at the time of the accident.  This sketch will be signed by each
                party involved in the accident
                (Here is where your pictures will come in)
  d)  The investigator will also require from  the parties involved as to what has been agreed  by them
                Likewise, here is where the liability of each party will be determined.
                This is where the copy of Insurance policies, contact persons, contact numbers are exchanged.
                Calls are made to notify the insurance companies or representatives of the accident.
   e)  Pictures of the damages incurred are taken.  The investigator makes the Police Report which will be needed for filing your insurance claim.

7)        Filing your Insurance Claim – Submit the following
            a)   Police Report
            b)   Repair Estimate by an Insurance Accredited Repair Shop
            c)   Pictures of the Damage (close up & from afar showing the car’s license plate)
            d)   Driver’s License with latest OR
            e)   Stencils of the car’s Engine & Chassis numbers
            f)    clear copy of the car’s LTO CR (Cert of Registration) & latest OR of registration
            g)    copy of your insurance policy

8)        For Third Party Claim (Property Damage) – Submit the following
            a)    Certificate of No Claim  - if you do not have a Comprehensive Insurance Coverage,
                                you will need to request this from the Insurance Company that issued your
                                CTPL (Compulsory Third Party Liability) policy
            b)    Repair Estimate by an Insurance Accredited Repair Shop
            c)    Pictures of the Damage (close & from afar showing the car’s license plates)
            d)    Copy of Driver’s License with latest OR
            e)    Stencil of the car’s Engine and Chassis numbers

9)        For Third Party Claims (Bodily Injury) – Submit the following
            a)     a Valid Gov’t Issued ID
            b)     NSO birth certificate (for minors)
            c)      Original Medical Certificate
            d)     Medical receipts with prescription,  Hospital bill
            e)     Other documents as may be required depending on the situation

10)      For Third Party Death Claims – Submit the following
            a)     Valid Gov’t Issued ID of claimants/heirs
            b)     NSO Birth Certificate
            c)     NSO Marriage Certificate (if married)
            d)    Certified Copy of Death Certificate
            e)    Certified Copy of Funeral Bill/receipts
            f)     Certificate of Employment / latest ITR (for loss of income)


11)      For Claims due to Theft of your insured Vehicle –  Do this  and Submit the following to your insurance company
            a)     Report the Incident of your stolen vehicle to the Anti-Carnapping Group and call your insurance company immediately   –

Ask around the vicinity where you had left your car in case someone may have seen the incident.
Observe if there was any nearby establishment with a CCTV camera that may have recorded the incident.
b)   Copy of Carnapping Report
c)   Copy of LTO OR CR of your unit
d)   Copy of your Insurance policy.

Make sure that you retain a receiving copy of the documents you submitted to the insurance company that is duly received with date and signature over printed name of the Insurance personnel that received your documents.  This is important as there is a 3 months waiting / recovery period.  If after 3 months your vehicle has not been recovered then the Insurance company will pay for the Actual Cash Value (ACV) of your stolen vehicle.

Note:  The Actual Cash Value of your stolen vehicle is not equivalent to the price of the brand new counterpart, so, expect to undergo negotiation with your insurance company for the amount that is fair for all.

This is the time when you can shop around for a replacement for your stolen vehicle.

just a question,naka loan kami ng sportivo+,price 1,235,000 and 9 months pa lang sya,36 months to pay then nalubog sa baha sasakyan namin last august at na declare sya na total loss by september na.Naka Comprehensive Insurance sya with AOG.Then binabayaran kami ng insurance ng 1,000,000 lang,so hindi namin tinangap kasi ang inilalaban namin eh yung total price ng sasakyan na nakasulat sa policy na dapat nila bayaran.Tama ba yung ipinaglalaban namin na dapat eh bayaran kami ng insurance ng total amount value ng sasakyan?
1 more question,: regarding sa bank loan,paano ba ang bayaran nila,kaylangan bang bayaran rin yung 27 months interest ng sasakyan or yung actual value lang ng remaining amount value ng sasakyan without interest?

Hi Roccs,
Actually, if at the time that your vehicle was damaged or totally wrecked, your unit is still mortgaged to a bank or financing institution, the insurance company is obliged to pay off the auto loan. It is only then [after the pay off], that you will receive your share on the insurance claim.

Hello Lalaine, Good day to you! If your insurance policy states coverage is P300,000, it means that is the maximum insurance claim possible. You stated that it was a minor car accident. So, shall we presume that damage was minimal too? What will be claimed per accident are repairs and replacements of the damage parts/area. This is determined through the Repair Estimate Report given by the accredited shop where you brought your unit for repair. This is to be submitted to your insurance company for approval. When the repair estimate of the shop is approved by your insurance company, the insurance company will issue a LOA [Letter of Authority] to the shop to proceed with the repair. The LOA also states the insurance share in the total repair cost. If you do not want your vehicle to be repaired at their accredited shop because you have your own preferred car repair shop, you can opt for a cash settlement claim with your insurance company. You have to notify them of your preference and submit the Repair Estimate Report for their approval too.

Hi to everyone.my car is a honda city 2011 model and was intentionally vandalized by a minor. We already settled with parent of the kid but she is asking if we can use the insurance for all the repairs. I already have an estimate cost of the repair, amounting to 5,500 php per door panel(2 doors were vandalized). My question is...what will be the ideal solution for this kind of incident? Do i use my insurance and have them pay for the participation or i will ask for them for the full payment of the repair? Hope for the hassle free and somehow fair for all parties

Good day Mam. A month ago, the trailer of a truck hit my car. The problem is that the insurance won't pay for the damaged accessories. The truck driver bore the fault. How do I demand for the payment of the accessories from the trucking company. They say that the driver is not with them anymore so that they can not get the payment from the driver. Good Day Mam. A month ago, my vehicle was hit by a trailer of a truck. The driver of the truck bore the fault and we had insurance fix the damages. The problem is that the insurance company states that car accessories are not part of the claimable. I am demanding from the truck company to pay for the damaged accessories of the car. The company said that the driver is not with them anymore meaning they won't want to pay me. As I understand, the time the accident happened the driver is still with them and it must be the company's responsibility to pay. How do I demand payment form them thru a formal process? Thank You.

Hi Mam. Thank you for the essential infos I got here. Hope I can ask you a favor to answer my problem. I have caused a minor damage to others car and admittedly its my fault. Upon negotiation, the car owner is asking me to pay an amount which is I guess not reasonable because its too high so I decided to help him to process his car insurance but he told me that the car insurance company will still seek for me to pay the damage that I'd caused. My question is, is it true that the insurance company of his car will seek for me and demand me to pay the damage that I'd caused? Your reply is highly appreciated. Thanks and God Bless.

Medyo hindi ko po kaya bayaran yung damage na nagawa ko kaya I decided to help him to process his insurance but he told me that I will still pay a certain amount to insurance company kasi daw maghahabol naman daw ang insurance company nya sa akin para bayaran ang damage na babayaran nila sa client nila. Hello Mr. Joseph Arabes,
Unfortunately, yes, the insurance company of the person whose car you damaged will run after you for the payment of the TOTAL COST of repair. As long as the police report or affidavit of incident will show that you are at fault.
During this cases, it would be best for you to appeal to the good nature of the person you had accidentally hit. Offer to pay for the deductibles [including depreciation percentage on parts replacement if the unit is more than 3 years]. It is better to pay for these rather than pay for the total cost of repair. Of course, the aggrieved party has the right to choose where he will have his unit repaired since sya me comprehensive insurance and sya yun agrabyado. If he is amicable to your offer, he will file for own damage - hit & run na lang.

this week lang po lumubog sa baha sasakyan namin dahil sa habagat. we are not worried kasi may comprehensive insurance ang sasakyan. pero ang problema sabi ng bangko kung saan kami nakaloan, hindi daw cover ng insurance sasakyan namin dahil hindi pa daw kami bayad sa insurance for the year 2013. nagtataka kami ngayon kasi nagbayad kami ng insurance october, 2012. pagkakaintindi namin since october kami nagbayad so cover kami hanggang october the following year. tama po ba? ang sabi ng bangko since april, 2010 namin binili ang sasakyan at same date din kami unang nagpainsured so month of april daw ang start at end ng coverage ng insurance. tama po ba ang sinasabi ng bangko? thanks in advance.

nagclaim po ako ng car insurance kasi po nbaha d2 sa olongapo, unfortunately na deny po kc nabili ko po ung car nung may 2013 so ung policy is under the name of the last owner. hindi po b cla liable na bayaran ung mga claims ko eh may deed of sale nmn po ako napresent sa kanila?

Be honored by the insurance company if the insurance policy is not under your name. The original owner should have transferred the insured's name to you when you bought the car from him/her. That insurance policy is useless unless the original owner is still around to file the claim for you. Best regards,

Good afternoon.

It's my first time to claim on my policy for my 5 yr old car. It was partially submerged in floodwater and we have AOG coverage. I guess I didn't completely understand my policy as such details were also not readily discussed when one renews a policy. Apparently, aside from the participation fee, I'm still to cover 25% of the cost of the replaced part. I just wanted to know whether this is the standard practice for older cars (3 yrs and above). Would you be aware of any reputable companies that do not have such clause or at least offer lower share for the insured? I paid almost 20k, then asked to pay 12k more for a 40k part relplaced. If I did not get the policy, just a few thousand more, I could have already replaced the part on my own.

My two-year old car financed by bank Hyundai Tucson car was totally damaged by Yolanda. We reported the total damage to the insurance and an adjuster went to Tacloban to see the car. they asked me to give them the car key kasi they will pull it our from where it is now, they will secure it and they intend to restore it. I just don't understand why they have to get the car. Di pa nga sila nagsasabi na babayaran nila kami o hindi. May bayaran pa kami sa banko na 36 months . Who will pay the bank? Do we have the obligation to give them the car key? Tama ba na sila ang kukuha ng unit? Thanks.

@Anonymous – you are still obliged to pay your monthly amortizations due even while your insurance claim is being processed. Before you give your damaged car to anyone, make sure they have the authorization of your insurance company to do so. They should present to you the Letter of Authority issued by your insurance company. It will state how much they will be paying the repair shop and how much is your participation in the repair. I also advise that you call up your insurance company to confirm the Letter of Authority that they issued.

If your car is repairable and categorized as a Total Wreck, then they are obliged to pay the bank the pay off value then whatever is left from the amount insured [less deductibles] will be given to you.

Good day. Would like to seek your advice po sana regarding a total loss insurance claim. I bought a new car (Mazda 2 hatch) last July 2013 (60 months payable). Unfortunately, got involved in an accident just before Christmas. Technically, at the time of the accident my car was barely 6 months old. My car is insured for P825k. If this is the maximum insured amount, would i be able to get that whole amount minus the participation fee? I believe wala pa dapat depreciation cost since 6 month old pa lang yung auto. Sa ganitong instance po ba, ang insurance po ba ang directly nakikipag negotiate sa bank or would it still be my responsibility? Kc if that were the case, i was thinking of talking directly to the bank and negotiate a settlement amount. Baka kc mapababa pa ang interest. Am i too hopeful to think na after all this, the amount i'll get from the insurance would be enough to pay off the remaining balance on my loan with some extra that i can use to
make a dp for a new car?

For minor damages, if the repair is minimal, you do not need to claim on your auto insurance. For total loss claims wherein the vehicle is still under bank financing, the insurance company will pay the bank first and whatever is left will be given to the assured. Best regards,:)

Kung wala po kayo Comprehensive Insurance. You should get your Certificate of No Claim from the Insurance Company that issued your CTPL.

I had bumped into another car when i was reversing. It was on last week. The other driver was in shock and didn't know anything so I gave him my contact no and ask his boss to call me. I checked their car and it was just a dent on bumper. So I thought i will just settle by myself instead of claiming from insurance co. So I didn't report. They finally contact me yesterday with the the quotation of 26000 pesos. Now I have to claim to my insurance. Will it be still ok to claim? Can i go and report police now? Will it be still claimable?

The Certificate of No Claim can be obtained from your insurance company. Please check your insurance policy - Comprehensive Insurance policy or the TPL [Third Party Liability] policy to know who issued your insurance coverage.

@Anonymous you can negotiate for installment basis. Unfortunately, at the time of the accident, all parties involved should have reached an amicable settlement prior to the issuance of the Police Report. The Police Report is a major report that insurance companies rely on.

I got involved in a minor car accident last Thursday. A ford focus hit my car causing a small dent on the right front fender. The offending driver concurred with the police investigator at the time of the incident which was reflected on the police report. However, a day after, he retracted and challenged me to hire a lawyer instead and file a case in court. My question is, do I have to pay the 5k participation fee/deductible to my insurance company or do I have the right to ask the insurance company to run against the offending driver and ask him to pay it? @Anonymnous, make sure to get the Police Report. If the report, shows the other party as the cause of the accident, then it is your ally in your case against the owner of the car that hit your vehicle. Even, if, they have retracted their statement.

@Anonymous, ng comprehensive insurance ang 2000 model. Comprehensive Insurance is available for units up to 10 years old only. I am sure wala ng insurance yun unit na yan. P15,000 participation for a 14 year old model - they are pulling your leg. Best that you accompany them to the shop and find our how much is the actual cost of repairs.

Honda po car namin wala pa 3 years. Nabangga po. Nung nagsubmit mo po kami ng insurace claim for own damage,may kasama na estimate nung taga Honda.
Then tumawag saamin yun insurer at ang sabi dun nalang ipagawa yun car sa accredited nila na shop para mas maskamura.

Pwede po ba namin ipilit na sa honda gawin yun sira?

Yung insurer po ba ang magddecide kung anong klaseng repair ang gagawin, e.g, kung irerepaint lang or papalitan ng parts?

Im a first time second hand auto buyer, and as far as the deal completed the auto is mine. However, both the seller and I thought that the insurance policy is also included.
Unfortunately, I got caught up in a minor accident. I tried to claim my insurance but was rejected due to late transfer of policy to my name.
I hope I can somehow find a way to get my claim because financially I'm still recovering.

My car was sideswept by a large cargo truck last week. The truck passengers & driver gave me copy of registration papers and copy of license ad I gave them mine.

I filed for police report, but the police report was silent on whose fault it was. The other party did not accompany me to file police report.

My insurance has all the papers now. Will the other party bother me over this, even if they waived their right to show up at the police station to explain their side?

Advise please.

@Dyay Moe You should have insisted that the driver of the cargo truck accompany you to the Police Station. The Police Report must indicate that they are responsible for the damage done to your car. At the police station, both you and the driver of the cargo truck that hit you should have issued a Statement of what happened. At present, you do not have anything on hand to substantiate your claim against the owner of the cargo truck that sideswept you. Me insurance din mga yun. But now, I do not think you can claim with their insurance company if they deny the incident. It would be best that you contact the owner of the truck and rely on his sense of fairness. Otherwise, file a claim with your company for hit & run.

@Dyay Moe, there is a difference between filing a Third Party Claim and filing a Own Damage Claim. As a Third Party Insurance Claimant, wala kang babayaran participation, all expenses for the retribution of the damage to your car will be shouldered by the other party's insurance company. But if you claim with your insurance company as Own Damage, you are to pay the participation / deductible plus the depreciation of parts replaced o
of your unit is more than 3 years old.

I insisted that the truck accompany me to the Traffic Bureau office, but due to the nature of the perishable cargo they were carrying (rice) and the heavy rain, they could not be held.

The casa folks said that I would pay for the participation fee. I think I can live with the participation fee.

The police Case Officer told me that it would be up to my insurance to go after the trucking company since the police report was issued 'ex parte' without the other party, just so my insurance company could pay out.

It was stated in the police report simply that V1 (mine) was hit by V2 (truck), and that the other party simply gave his license and registration copy. Is this enough to establish his fault?

Hello Dyay Moe, just as the police Case Officer has advised you, it is now your Insurance Company's problem if they will go after the other party for payment. There are legalities involved in that. I do not know if what you gave is enough for them to establish their fault. The police report you have is only to comply with your requirements to file an own damage claim. Based on my experience, a Third Party Claim is effected when the Police Report specifically states who the guilty party is. And they can only do that if they have both your statement, the other party's statement and a sketch of the incident duly acknowledged by both parties involved.

The Participation is the same as deductible. The initial deductible is stipulated in the page where the coverage breakdown is stated. There is another deductible for cars older than 3 years. This is for replacement of damaged parts. There is a depreciation table in the insurance policy showing the deductible percentage from the cost of the brand new part that will replace the damage part. Best regards,

Just a question regarding claiming of total wreck. You mentioned in reply to rocc's question that "It is only then [after the pay off], that you will receive your share on the insurance claim." I want to see how the computation works po. Let's use rocc's values nalang din. A sportivo+ amounting with P1,235,000 and 9 months out of 36months paid. I've read on some internet sources that the market value plays a valuable role for total wreck claims. If the Fair Market Value of the vehicle is around 900k and the vehicle is still mortgaged to a bank, how is the after pay off computed? Is it the FMV - current balance to bank? e.g 900k (FMV) - 700k (balance for the remaining 27mos) = 200k (amount you will receive)

Hi Miriam. My wife and I bought a Ford Ecosport last April and had it insured by Prudential Guarantee with AOG coverage. The car got flooded last August and it is only now that the insurance company released their LOA. However, the cost estimate attached to the LOA has note from a Prudential employee asking the dealership to peg the price at Php519.60 less than the cost estimate because otherwise, the vehicle will be declared as total loss. I submitted a letter to appeal for a total loss claim due to the nature and cost of repairs. Am I at an advantage since they had to haggle the cost to justify their repair recommendation? And if they would offer for total loss,am I justified in asking for the market value we paid for since the car is only 4 months old?

I loaned a car via eastwest bank, 3 days after I got the car my wife accidentally crashed the car to our fence, we claimed an insurance and after a month and a half it was about ready to be released from the casa unfortunately during the reassembly they found a crack on the engine block then they declare it to be totaled. Car value is 485k and bank loan is approx 600k. I already paid my 1st month due. My question is how much will the insure company pay to the bank cause they say pay off will be processed. I am worried that I might have to pay a big amount to clear my name with the bank.

Hello po Ms Miriam. I hope you can help us. We filed a claim po from BPI MS. What happened was, one day after parking overnight sa open street, our car was maliciously damaged. The side mirror (right) was taken off pero they left it sa lapag with a crack, then the right passenger rear door, looked like they tried to open it (bent) and then several markings sa left and right panel (lines/scratches). The insurance approved it pero they're saying there should be 3 participation fee because its per panel and the nature of attempts. Isn't it just one attempt and should only have one participation fee? Thanks a lot! Kathy

Hello Ms Miriam , I got involved in an accident recently. I was signaling left bcoz there is a car accident infront of me. When I slowly maneuvered , the car behind accelerated thus led to collision, it leaved a long scratch on his quarter panel coz he didnt stop, he stopped 2 cars away from me.

My question is, can he claimed from me? he holds TPL insurance only while I have comprehensive. The police report is negative on my side but i did insist that its not my fault.

@Anonymous, if you agree to pay for the participation fee pls make sure that the owner of the Honda Civic does not include your name in his insurance claim. Otherwise, the insurance company will ask you to pay for the balance on the repair too. We can not assume that a damage will require minor repairs only. Maybe you can offer to meet with the Honda Civic owner at the casa where he plans to have the damage repaired. Well maintained ba yun Honda Civic na nasagi mo?

nasagi po kami while our car was parked, good thing pabalik na kami sa car at naabotan yung nakabangga. we also were able to file police report pero wala yung 3rd party since nagmamadali umalis. we have agreed that they will shoulder the expenses pero gusto nila ipagawa nalang sa labas instead of casa. My hubby does not want ipagawa s labas kasi new pa yung car, and he also does not want to file any claims in insurance kasi baka daw magakrecord pa yun bagong car namin. tama po na kami on that?

also, the 3rd party was asking us to send the copy of our or/cr. when we asked what for, sabi for report daw. is it okay po ba to give copy to them? natatakot po kasi kami na baka ano gawin nila with our or/cr.

hope you can enlighten us, it is really hard for first time car ownsers like us, regardless of how prepared we are when we got our car pag nangyare na ang incidents like this ang hirap lalo na pag pasaway ang 3rd party.

@Anonymous, It is alright to give them a copy of your LTO OR/CR. However, find out why they need the copy. Do they have a Comprehensive Insurance Coverage? Find out what is their insurance company so that you can coordinate with them the repair for the damage of your unit. Have your unit's repair estimate done at the repair shop you want. As the aggrieved party, you have the right to demand where you want to have your unit repaired.

My car insurance had already released an LOA for the repair of my car and they are telling me to pay a certain depreciation amount for the parts as stated in the insurance policy plus the deductible fee. According to the Police investigator of the case, if i will file a claim, I would surely win the case as seen from the incident area. My question is this, Can I claim the deductible fee and and depreciation amount from the bus company i had collided with. May I know what is the best thing for me to do because I am the breadwinner and can not afford to chase the bus company operator where i collided with.

Last Sept 2014 nabangga ung kotse nmen at hndi kme ung at fault, supported nmn po sya lahat ng needed requirements pra mkapag file kme ng claim sa nkabannga, in short po na ipasok na s casa ung kotse for repair nitong january lang. ang insurance po ng nakabangga smen ay stronghold. after a week tumwag n po samen ung casa na ok n daw po ung kotse hndi p lng ngbabayad ung strong hold,,isang linggo n nmn po lumipas hndi pa din nmen mkuha ung kotse dhil hndi pa din po ngse settle ung stronghold,ang dahilan nila is wala dw po pipirma sa releasing at sa adjuster. ano po ba ang pwede nmen gawin pra i complain ang stronghold at mkuha n nmen ung kotse nmen,,salamat po.

Hi Ms. Miriam. First of all would to say you're one nice and very accommodating lady sharing your expertise to your followers with their insurance claim woes.
I have one myself. We were rearended in NLEX by a vehicle with no comprehensive insurance. We had an amicable settlement and signed a form at the scene, upon advise by the NLEX Traffic Officer, that he willl pay for the participation fee when I file my claim with my insurance company. Involved in the accident is another vehicle which we hit on its rear. The accident is supported by a police report prepared by NLEX and will be used to file my claim for own damage on the front and on the rear.
How will the amicable settlement document affect my claim for the repair of the rear end of my unit? Will my insurance allow my claim with the amicable settlement form present?

They accompanied me to file a police report but it was already late in the evening. They requested that we file the report the following day. However, they didn't get in touch with me. I feel like they're just giving me the run around. I understand that it's a company vehicle that collided onto my car so the company should take responsibility. I'm thinking of filing an own damage to expedite the repair of my car. Since there is no sense of urgency from the company who owns the vehicle, legal wise, can I file a lawsuit? I know this is off-insurance topic but I was hoping you could provide some advice.

Hi po madam. Ask lang po regarding sa concern namin. Last sunday po kasi meron kami nasabitan sa parking lot. At first we want na aregluhin na po sana or ipagawa na that time para wala na masabi, pero still may other party na relatice nung may ari ng car ang nakialam and sinabi na pagusapan nlng muna daw tapos ittxt samin. Syempre po since wala kami alam sa ganun pumayag po kami na magttxt since ang understanding namin ay ittxt samin kung ano mapapagusapan. Then after 2 days nagtxt po ung naagrabyado na party na ipinagawa na nila at sinisingil samin ung worth. Then syempre sa part namin nagulat kami na basta nalang singilin kasi ang pagkaintndi nga namin ittzt kami para pagusapan or wat pero hndi ung tipo na naipagawa na tapos singilin agad kami kasi hndi namin alam saan ipinagawa, ano ung ipinagawa? Wala din po police report since umalis nga po agad sila sa place of incident.. ano po kaya ang pwede legal na processo na gawin?

hi ms. mirriam, I accidentally bumped into another car na naka-park.. pinasok namin through insurance and ni-cover ng insurance company ko lahat ng damages kasi ako nmn tlga may fault.. kaya lng ngyn gusto din nla na bayaran ko ung transpo expense nila amounting to 8k for the time na ginagawa ung sasakyan nla.. kailangan ko p b bayaran yun? if yes, reasonable na amount ba yung 8k? kasi i was thinking na if the accident dod not happen they will still need to spend for gas and parking. Nabangga po ako ng tricycle. Tapos pag dating sa pulis, ako pa daw ang may kasalanan habang sya itong sumingit sa gitna ng kalye. May police report po ako. May insurance din. Sinisingil ko yung tricycle kahit pambayad na lang ng deductible pero ayaw pa rin nila at sila pa ang galit. Lagi ko po nababasa sa response nyo na dapat lang bayaran ng may sala ang damage sa property pero paano pag ayaw nila magbayad? At paano pag hindi nagkakasundo ang both parties? Ano po ba ang dapat gawin aside sa kumuha ng police report para sa pag claim ng insurance? Paano ko sila mapagbabayad? Hahabulin ba sila ng insurance ko?

My car is 11 months old when I was bumped by a freight liner truck that damaged the left front and rear door.In the police report it was the fault of the truck driver but then during settlement.I realized that I had an expired drivers licensed. Can I still claim the damages at the truck's insurance even with the expired license? Hoping for your response ma'am. Thank you.

Dear Anonymous, unfortunately, since you were driving with an expired license then it is the same as driving without a license. Therefore, you cannot claim from the truck's insurance as you were driving illegally.

Kindly help me with my concern.

The insurance of the other party is asking me to pay 50% - 60% participation on the damages. The company car driven by the other party has no full coverage insurance.
I mentioned that I can not readily pay the full amount.

The other party has sent me an email asking me to do the following:
Deposit the down payment of 50% of the Total amount.
Insurance to be used is paid by the company, reason why the company demands payment of the full amount. (?)
Then other party is asking me for my preferred terms on how I can pay.
Also, mentioned that depreciation of the car does not matter because the replacement of the parts is charged as new.

If I will not pay the full amount the unpaid amount will be salary deducted to the other party by her company and if that will happen the other party have no choice but to sue me and contact my employer.

Q: Can the other party personally sue if I can not readily afford the full amount?

Good afternoon, I would like to seek your advice on this.
If you already took advantage of your insurance and you were able to track down the owner of the vehicle who hit and run after bumping the rear side of our car, how much will they be liable?

In our case, they are insisting that they will just pay the participation fee. I heard one case wherein the party at fault paid the whole amount of damages even it was covered by the insurance of the victim.

The damage is amounting to 60k which is covered by our insurance and they are insisting that they will only pay the participation fee which is about 4k.

Our car was hit by a car at the left rear side by another vehicle and the driver drove fast after the collision. We had to track cctv's over the area to get the plate number for days. That was the tiring part. If only they stopped at the time of collision and settled it right away then perhaps we won't be forced to ask for the whole amount of damages.

Naguguluhan po kasi ako regarding processing insurance claims. My 2015 model toyota fortuner bumped to a tree jan 30 of this year. Kakakuha lang po sya sa toyota last december, so 1 month pa lang. And naka - loan po sya sa psbank. Magstart pa lang ang amort. Initial estimate po ng toyota 1s around 820k. Comprehensive insurance po amount for own damage is 1385k. Parang 60% na po ata yun ng vehicle cost. Di pa po sya na-assess ng insurance pero the estimate daw can shoot up pa. Kapag ganun po ba, papalitan na kaya nila yung unit? Or babayaran lang nila ang bank, and yung excess lang sa amort ang ibibigay nila sakin? Sana po matylungan nyo ako sa kalituhan ko. Salamat po.

I am Gil and I hope you could give an advise on my case.
I have a driver and he bumped into an accident. He collided to another vehicle (Kia Sorrento 2014) affecting the 3rd party's right side. It was badly damaged affecting 3 panels... Police report has been produced without saying a clear statement on who the culprit is. It only states that vehicle 2 collided with vehicle 1 which can be interpreted into multiple meanings. Although the outcome of the accident is more prominent that it is my driver's fault, I am finding ways on how to resolve the issue without shedding off some money on my pocket. The estimate of the damage on Kia Sorrento (3rd party) is quoted to Php350,000.00 repair. My insurance can cover only Php200,000.00 for the 3rd party liability, the remaining Php150,000.00 is hard for me to produce in an instant. Is there any another way on how can I skip the Php150,000.00 balance without getting sued? Can I negotiate with the 3rd party to settle this via insurance to insurance even if there is already a police report?

Hello all, please read your insurance policy kasi dyan naka indicate sa insurance policy kung magkano ang participation/deductible mo in case of "Own Damage" claims. Also for vehicles more than 3 years old meron din table sa policy on how much is your % share in case of brand new parts replacements for damaged parts.

As long as the Police Report indicates that you are responsible for damages in an accident, it is 100% sure that the insurance of the other party will run after you for payment of repairs, regardless, of what you and the other party settled on. Best regards,

@Anonymous yes sir, if you will have your broken headlights replaced by brand new ones, you will need to pay for the participation. Since your car is more than 3 years, you will also share in the depreciation cost which is computed based on the table in your insurance policy. However, there are car shops where you can buy authentic brand new parts at a cheaper price than the ones they may have canvassed.
Suggestion: You can canvass for a car shop that offers a less expensive brand new set of headlights for your car. Then request for a cash settlement with the insurance company. If they approve your request, you just need to surrender the broken headlights and they will give you the cash to buy new ones. Pay a qualified mechanic to install your headlights properly.

Good day mam! May van kami hi ace commuter 2006. Nagasgasan sa door side nang biglang natumba ang "no parking" signage na katabi habang nagpapark ang father-in-law ko. Nagclaim kami sa insurance company last month since comprehensive naman insu namin. Sobrang tagal ng processing. Tapos in the end, malalaman lang namin na 350pesos nalang daw ang mabibigay nila kase nagdepreciate na ang value ng sasakyan. Tama po ba un? And under pa ng financing ang sasakyan namin. Hindi naman kami binigyan ng copy ng policy para sana naging aware kami sa depreciation value ng sasakyan na sinasabi ng insu company namin. Puede ba namin panagutin ang financing company dun? If you have not filed the incident at the Police Station, kindly produce a notarized Affidavit of Incident (narrate the circumstances that lead to the damage to your van) and submit this together with the other requirements for your insurance claim. Make sure though, that you did not park illegally (no parking zone) as this will be one consideration by the insurance company to deny your claim. Best regards,

Yung first po kasi, mga 3k lng naman yung babayaran so sabi po namin na kami nlng yng magpapa repair. The first incident po was oct. 2015 pa pero d po namin sya npa repair. But the owner of the Montero insisted na palitan ung buo harapan ng montero. Ang nasagi po n part ay ung sa side ng harapang gulong. Ano po ba ang pede pa namin gawin. We cannot afford to replace the entire part of the montero and considering maliit po ang damages.

Hi Po. Nabangga po yung car namin today and aminado naman po yung nakabangga sa amin na sila yung at fault. Di na po kami nag pa police report and pinaayos nalang po sa third party autoshop and sila po nag shoulder lahat ng cost.

Ask ko lang po if okay lang po yung ganung areglo since sila naman nag bayad ng total cost. Or much better po talaga na sa insurance namin pinasok yun? Just wanted to know lang po kasi if wala naman po ibang disadvantage na inareglo siya outside insurance. Pareho po kasi bago car namin. same 2 months old. Thanks po!

Hello po. Nabangga po yung taxi namin ng truck. Sinagot naman po ng insurance ng may ari ng truck yung repair kaya lang it will take 1 week bago marepair. Can i ask for damages for my lost income while the taxi is being repaired? Thanks po and more power.

Hi ask ko lang po ung nangyari accident sa car ko. Sa parking lot po nangyari. Ako ang nasa right way and ung isa car ang palabas ng parking. hindi ko sya nakita kc lampas na ako sa kanya nun umatras na. My car was hit sa left side sa hulihan part na. wala ako insurance and sya meron. Hindi nya admit na 100% at fault sya. Hindi kame na nakatawag ng police to investigate since sa office parking lot sya nangyari and malayo sya sa nearest police station.But we have taken pictures of the incident. I am sure na hndi mabilis ang takbo ko kc I am near approaching the guardhouse and we are supposed to stop there for inspection. So speeding is nearly not possible. She is ok na sagutin ng insurance nya ang pagpapagawa ng sasakyan ko pero she insist na maghati kame sa participation since hindi daw sya 100% convince na sya lang ang may kasalanan. I asked her to talk to the person who was able to witnessed what happen but she refused. Kindly advise what is best to do? Can I furnish my own affidavit of incident and panu ko sya hahabulin to pay for all the damages. Hoping for your feedback.

Question lang po sana.

May vios po ako na 5yrs to Pay sa Eastwest bank. 6 months pa lang sakin ung sasakyan. Naaksidente po ako last May 31, 2016.

Ask Ko lang po sana If I still need to pay the Interest of the bank, kahit na isettle ng insurance ung full amount ng sasakyan.? (Which is I hope ganun ung gawin ng Insurance)

Got Accident po in my Vios Last May 31, 2016. Na quote na po ng Toyota ang total damage and it is a wooping 900K. so I think malabo po syang bayaran ng Insurance since ang insured lang po sa unit ko is ung SRP. (6 months Old palang po ang car).

May question po is.

Kung idedeclare po ng insurance na Total loss po ung car ko. mag kano po dapat ang ibabayad nila? naguguluhan po kasi ko sa computation ng depreciation. ang alam ko po kasi Yearly ang depreciation hindi monthly.

And since 6 months na po ako nakahulog and continues pa din po ang hulog ko ngaun kasi wala pa naman po na dedeclare ang insurance upto now (6-14-2016). Tanong ko lang po sana if I still need to pay ung Bank Interest just in case na bayaran na ni insurance ng buo ung amount ng car.

Naginvest po kase ako ng taxi sa pinas, unfortunately sabi po ng operator eh nacarnap daw po yung isa kong taxi, bale dalawa po yung taxi ko sa pinas, its been 7 months na po since nacarnap yung kotse and hindi na po narecover...sabi po sa akin ng operator wla pa din daw po offer ang insurance company dun sa 2013 vioz ko po...pano po ba ang dapat gawin.. and monthly po binabayaran ko pa din po ang amortization na matatapos na po sa october 2016... salamat po...

For carnap vehicles, 3 months lang waiting time for the recovery period afterwhich the insurance company is suppose to commence the settlement of your insurance claim - under "Theft". If you have not received their offer, you can report and file a complaint against the insurance company to the INSURANCE COMMISSION OF THE PHILIPPINES. Their office is located along U.N. Avenue, if I remember right, it is just beside a police station there. Diagonally across Medical Center Manila, U.N. Avenue side.

I need some advice. Got into an accident last Feb. di ko kasalanan pero sa police report kasalanan ko daw. Anyway talked to he driver sabi ko shoulder ko nalang yung participation fee. sila lang yung may comprehensive insurance ako TPL lang. now I just received a mail from their insurance company asking me to settle 100k. Unfortunatley I can't afford to pay that much.

Diba dapat since insurance sila babayaran na nila yun damage? bakit pa ko sinisingil? kaya nga sila insurance. What will I do? willing naman ako bayaran / shoulder ng hindi covered ng insurance kaso hinihingi sakin yung full amount. I need your expert advise please. Thank you.

The following day, I went to my dealer to have my car check and estimate the total damage. They quoted 91k for the repair. Since my car is insured, I only needed to pay the participation fee. But it would take minimum of three weeks at the casa. So I asked the owner of the truck if they could pay me half of the total damage for the hassle of not be able to use it for three weeks. They declined & they just wanted to go to their suking body shop repair. My question is, do I have right to impose to them that I wanted the casa to fix my car? And what is my right about the reasonable price that I need to ask from them for the hassle. Please... Need your help on this. thanks...

Tanong lang po. I was on an accident last july 2, someone bumped me on the rear on a stand still traffic(the driver sa likod ay nakatulog daw).. So we got into agreement to have it estimated sa nearest Honda.. my car is just a month old when it happen. So after the estimate, we agree to put it on his insurance. after a few weeks his insurer pay me a visit to inspect the car. take picture and stuff need to be done.
I also ask my insurer to provided my a copy of the policy. then after than ask them to give me a Certificate of "No claim", well long story short, I just received it earlier and forwarded it to the said driver. siguro by tomorrow ipapadala na nya sa insurance nya.. may friend sya sa insurance so might take no time if ever man marerelease yung LOA.

now my concern and question:
1. Do the LOA has validity period?
2. if yes, then how many weeks do I have before it expire?

my concern is, kelangan ko nung car this august 18, may event akong pupuntahan, so I was planning to leave the vehicle sa casa after august 18, I have other means of transpo(Motorcycle and Bicycle).

Hi, good day. Query lang. Is it possible for both parties to file an affidavit. Since the other party suggested, huwag na ilapit sa Pulis. and what happens if both affidavits have contradicting statements putting the blame on each other.

my car was damage by a delivery truck on site while unloading construction materials. it was damaged by the materials and not the delivery truck itself. they want it covered by the insurance of the delivery truck. Is it possible na ayawan kong padaanin sa insurance nila and i want it payed in cash kc isang panel lang naman ung damaged. Aside sa damage sa car na sira rin ung kulungan ng dog. Pwede rin ba humingi ng pagpapagawa sa damage property?

@Joel It is useless if both parties will not admit any fault. Since both of you have comprehensive insurance coverage, it won't hurt if the one at fault will admit it. Because he/she can use his/her comprehensive insurance to cover for the repairs on the damage of the other car. Both the aggrieved and the one at fault will have peace of mind because the insurance company will cover the repair costs up to the limit stipulated in the policy - P100,000 or P200,000 or P300,000 or P500,000. If the aggrieved party has a comprehensive insurance too, he/she just needs to get an Certificate of No Claim from his/her insurance company.

@Mark Anthony Quias yes sir, as the aggrieved party you can insist in their immediate cash settlement to the damage cost by their truck. They can always get reimbursement from their insurance. However, you'd be considerate to cooperate with the other party so that they can recover their loss by submitting the requirements for their claim with their insurance company.

May question rin po ako.

Kung ang damage po ng sasakyan is bumper then insurance evaluator opt for replacement, which is for sure mahal and problema pa po is over three years na yung sasakyan kaya may 20% ng depreciation share. Ang tanong ko po is, kung sakaling pumayag sila ng palitan ko nalang ng replicate bumper from shops na malayong mas mura sa oem bumper, Do I still have to pay for the 20% share for the price ng replica? Or it only applied to Brand New OEM?

@Exzer Hello po. 20% depreciation share applies only to brand new replacement parts. If you will be amenable to the surplus replacement, you don't have to pay for the 20% depreciation share. However, you will still shoulder the deductible for the insurance claim. Best regards

I just hope to inquire, though a bit off tangent sa insurance claim, kung paano ma-trace ang isang sasakyan, a closed van in particular, na naka-gasgas po ng front side ng front bumber namin (buti di nabasag yung glass headlight cover pero malapit dun yung gasgas), nangyari po ito nung October 29, 2016 along EDSA. Ang gusto lang po sana namin mangyari ay makausap mayari ng closed van at kahit paano ay ma-reprimand yung driver nung van at the time (na nakuhanan namin ng picture, bata pa) na huwag maging reckless sa pag-drive, nangyari po kasi ang incident dahil nag-cut siya bigla sa lane (inner lane) dahil gustong mag-overtake. Ang conduction number na nakuha namin ay NK4292 na may tatak na Coolaire yung kaha ng van (na may contact number ng Coolaire, na natawagan naman po namin, kaya lang ay sila lang daw nag-install nung pinaka-kaha nung van at di po nila alam yung nagma-mayari nung closed van - at least yun ang sabi nung nakausap ng misis ko at the time na natawagan namin, ang naipangako na lang po ng Coolaire ay tatawag sila uli sa amin kung may impormasyon silang makukuha tungkol dun sa nasabing closed van na pinagawa sa kanila). Hope that you or other people knowledgeable about this can help.

Hello did you notice the brand of the truck? Knowing the brand of the car will narrow down your search to the car dealers of that specific brand. You can also approach the main LTO for help in your search. Regards

Body Builders issue a Certificate on the type of body they install on the truck's cab and chassis. This is needed for the LTO registration of the unit. It is issued to either the owner or to the auto dealer. So I am sure they have either info on their files.

My car got involved in a multiple collision accident.

V1 - My Car
V2 - 2nd Car
V3 - Taxi

All vehicles were traversing the same direction, V3 (Taxi) bumped the V2(2nd car) and eventually hit V1(My Car). We all agreed to use V3's comprehensive insurance. The problem is that V3's 'Property Damage' coverage is only Php 50,000.00. The estimate on V1's car damage is way beyond V3's limit(Php 120,000). V1 has a comprehensive insurance and is a 5 year-old car hence subject for depreciation. I V1 will use his own insurance as own damage, can V1 force V3 to pay for the participation fee?

Hi Anonymous, it is V3's obligation to pay for the total repair of your vehicle regardless of whether their insurance can cover the total repair cost or not. It would be prudent for them to pay your deductibles n depreciation cost. However, your insurance will eventually run after them to pay the rest if the police report indicates them to be the cause of the accident.
