Steps to do after full payment of auto loan

Buying a brand new car through financing is easy because there will always be a bank, an automotive dealer or an automotive sales executive who will assist you in this process.  But do you know what to do after you have fully paid your auto loan?
Here are the steps to do after full payment of your "AUTO LOAN"
1) Release of Chattel Mortgage and  Original LTO Certificate of Registration with
     Official Receipt (Encumbered)

Go to the Head Office of the Bank that financed your auto loan and claim the following documents (expect to pay the Notary Fee)

    a) Release of Chattel Mortgage and copy of Promissory Note
    b) Original LTO Certificate of Registration (CRE) and Official Receipt (OR)

Processing Time:  I suggest that you call the bank first.  Find out when they can release the above documents.

I just paid-off my auto loan with Union Bank of the Philippines.  They have advised me that I could get the Release of Chattel Mortgage & the original LTO Certificate of Registration (Encumbered) at their Head Office in Ortigas after 10 working days.

RCBC Savings Bank - Tel #s 555-8772 / 555-8700
Banco De Oro - Tel #s 688-1288 / 68801468 ask to be connected to SFU
                           [Service Fulfillment Unit]
BPI Family - Hotline - Tel # 89-100 - follow voice prompt for options
PSBank - Hotline - Tel # 845-8888
Union Bank of the Philippines - Hotline - Tel # 84-186 or 841-8600

2) CANCELLATION OF CHATTEL MORTGAGE

Go to the Register of Deeds in your area of residence, submit the "Release of Chattel
Mortgage with Promissory Note". (there is a minimal fee to paid here).  The Register of Deeds will issue you the cancelled Chattel Mortgage..

Processing Time:  Cancellation of Chattel Mortgage varies with every City and Municipality. There was a time when you can receive the cancelled Chattel Mortgage within one day.  In fact, I assisted a client to get his at the Register of Deeds in Mandaluyong City and we only waited for an hour.  My husband and I assisted another client to get his at the Register of Deeds in Quezon City and he was advised to come back after 3 working days.

3) UNENCUMBER THE ORIGINAL LTO CERTIFICATE OF REGISTRATION

Go to the LTO Agency that issued your LTO Certificate of Registration.
You can find this information at the heading of your LTO Certificate of Registration.
You need to bring the unit for inspection and stenciling. (There are corresponding
Fees for this procedure)

    a) Submit your "Release of Chattel Mortgage" that has been duly stamped
"cancelled" by the Register of Deeds and your OR of payment for the Cancellation
    b) Surrender your "ENCUMBERED" Original LTO Certificate of Registration
    c) The LTO Agency will release a new LTO Certificate of Registration to you that no
longer has the word "ENCUMBERED" on it.
Processing Time:  Please ask the LTO Agency you are dealing with, if you could
wait for the Unencumbered LTO CR or if not, when can you return for it.

4) You now have your original LTO Certificate of Registration. Keep it properly.

Keep your original LTO Certificate of Registration and the latest LTO Official Receipt
with your personal documents in a secured place. Keep a copy of these in your
vehicle. You are now the proud owner of a unencumbered vehicle. SMILE! :)

TIPS AND UPDATES:

a) Where to claim your Original Encumbered LTO CR/OR & Release of Chattel

b) Time-saving Tips

          vehicle.

mga ilan days po makukuha ung clean CR from LTO? thanks

Miriam Barredo said...

You will have to ask the LTO Agency the answer to your question. :)But the last time it took 3 working days.

This article helped me a lot. Just a question, LTO asked for the latest registration OR of the vehicle (since the car was registered last june). After the processing, LTO did not return that OR (dated june) but issued a new OR together with the updated CR. Is this normal or should the OR dated June returned to me too? Thanks!

Hi,

I just applied for BDO autoloan, ng 2nd hand ng car.

Thanks,
mike

Miriam Barredo said...

Hello, you do not need the old OR since you were issued a new OR already.

Miriam Barredo said...

It usually takes 5 days or more for the verification of car history. To speed up this process, you can ask for the name of the LTO employee who processed the transfer of ownership of the car to you. You can give his name as reference to the bank who will be issuing your loan. This is so that the bank investigator will know who to approach. Read my blog on "buying a used car through financing" at

Tapos na yung car loan ko with BPi and i already have the docs. Next thing to do is to go to Register of deeds in Makati. My car was first registered in LTO muntinlupa 4 yrs ago but the renewal registration for the 2011 and 2012 was done here in LTO makati. Do i really have to go to LTO muntinlupa to get the unencumbered CR?

Miriam Barredo said...

Hello Mulberry Girl, to have "encumbered" removed or to unencumber your LTO CR, you really need to go to the LTO Agency where you unit was originally registered.

Anonymous said...

hi. How much is the processing fee to unencumber the vehicle?

Anonymous said...

Miriam Barredo said...

Around P700 - P 1,000, bring P1,000 for your budget. And For your convenience, I suggest that you have your LTO CR unencumbered when you renew your LTO Registration.

mistersinister said...

Wow this is so helpful, thanks!

My car loan ended last August, I already have the Release of Chattel Mortgage. However, my car registration plate ends in 1 (as I prefer coding on Mondays)

I also prefer to have my car dealer help me in my registration so I talked to their rep. I asked since my plate is ending 1 can I just have the unencumbered status made coincidental with my annual registration in January? So for now I will be using the encumbered registration valid until January.

This is okay naman, right? Thanks so much!

Also the register of deeds needs to be in my residence, right? Regardless of where I bought the vehicle, and where it was first registered? Anyway I plan to just keep on registering it in Muntinlupa (where it was first registered by the dealership) even if I reside elsewhere... just for convenience. Just want to remove the encumbered status of course.

Miriam Barredo said...

Hello, yes, po. You can have your LTO Cr Unencumbered when you go to the LTO Agency for your renewal registration. However, you need to go to the LTO AGENCY where your unit was originally registered to get the Unencumbered LTO CR. The following year you can renew your LTO Registration anywhere.

It really is your choice if you want to get the Unencumbered LTO CR or just hold on to the one you presently have. Sooner or later, however, you will have to get your Unencumbered LTO CR. Like when you sell your car, the buyer will look for the Unencumbered LTO CR.

By the way, you need to get the Cancellation of Chattel Mortgage at the Register of Deeds in your place of residence before you can request for an Unencumbered LTO CR at the LTO Agency where your unit was originally registered.

If you use, the service of your car dealer, you can give your Cancellation of Chattel Mortgage to them when you have your unit's LTO registration renewed through them.

By the way, for provincial clients who bought their unit here in Metro Manila, they can request the bank branch nearest them to request the Bank Head Office to send their original LTO OR CR and Release of Chattel Mortgage to the branch or business center for pick up.

Miriam Barredo said...

Hello, it took 1 month after submission of requirements for the financing bank to give me a copy of the Encumbered LTO CR and LTO OR of my unit. Regards.

Anonymous said...

hello! just to be clear.. i just need the (1) cancelled release of chattel mortgage and (2) encumbered original lto certificate of registration and go to the lto where my vehicle is registered to get a new certificate of registration without the word "encumbered" on it right? oops i forgot of course some (3) money for the fees.. :)

i just need those three things then im good to go right?

thanks in advance Ms Miriam :)

Am i allowed to process my boss papers? for cancellation of mortgage, do I need some authorization letter from him? does it needs his valid ID's how many? do i need to bring stencil for the unit chassis and engine in going to ROD and LTO?

Miriam Barredo said...

Hi Rachel, yes madam, you need an Authorization Letter from your boss, clear copy of your boss' valid gov't issued ID.

No need of stencils for ROD.

For LTO, you need to bring the unit inspected and have the engine and chassis stenciled. Documents to be submitted at this stage -
1. Original Certificate of Registration (CR) and latest original Official Receipt (OR) of payment
2. Cancellation of Chattel Mortgage by the Registry of Deeds
3. Official Receipt (OR) of payment with Registry of Deeds
4. Motor Vehicle Inspection Report (MVIR) (Motor Vehicle Inspection Report)
5. Taxpayer's Identification Number (TIN)

At this stage, you may seek the assistance of the dealer where the unit was purchased.

Most of our clients come back to us at this stage for their convenience.

Miriam,

What an informative blog you have here! Thank you. Just a couple of questions: How long does it usually take to have the Register of Deeds cancel a chattel mortgage on a vehicle? It has been two weeks in my case and my status is still in the "Approval" stage in the LRA online tracking system. It has been on the approval stage for most of the two weeks. At first I was told to come back to the office one week after I submitted my documents. I thought I would be able to complete the transaction by then, but I was told it was just one week for follow up only and that it is still on the approval stage. They gave me a number to call to follow up again after a couple of days, but this time I was told that the person in charge of approval is not in the office. I called again two days later when the person in charge of approval was there, but was told again to follow up the next day because he had a heap of papers to approve. It's been two days since that last call and the status is still on approval. What is going on? What can I do to speed up the process?

Hello Don, if the original CR (Certificate of Registration) is still encumbered, you should ask the owner to give you the Release of Chattel Mortgage from the bank of his auto loan. In fact, it is the seller's obligation to provide an Unencumbered Original Certificate of Registration to the buyer. This is proof that the car owner no longer has an auto loan. Otherwise, the owner must pay off his auto loan first before he can sell you his car.

Anonymous said...

Thank you Miriam for the list of government agencies you posted where we can file a complaint. We'll give them a try, and hopefully the person in charge in our Registry of Deeds here will not give us a hard time.

Miriam,

I just got the cancellation/release of chattel mortgage from the Registry of Deeds. I'm about to take an encumbered certificate of registration to LTO and have it changed to my name because I'm the new owner of the car. How long does it usually take for LTO to complete this process?

Thanks for your informative blog and thanks in advance for your response.

Hi Miriam!

Great blog!

Just wanted to check with you.
I am getting a car in Manila with Encumbered on it. The seller has the release of chattel from PS Bank. He will still get other docs from registry of deeds.

My questions is. If I bring the car to the province before having it "unencumbered" from Original LTO, Can I still do this in the province with my local LTO? Planning to bring it right away to Iloilo.

Thank you!

Miriam Barredo said...

As stated before,"Go to the LTO Agency where your vehicle was first registered. You can find this information in your LTO Certificate of Registration. You need to bring the unit for inspection and stenciling. (There are corresponding fees for this procedure)" - this means you can only have the unit unencumbered at the LTO Agency where it was first registered. You can not have it unencumbered at any other LTO Agency.

Do i still need to,go to ROD Manila for the cancellation? Thanks for your advise. - paul

The original LTO OR CR submitted by the car dealer to the financing bank is not yet encumbered. When the financing bank receives the original LTO OR CR from the car dealer ay ipapa encumbered pa nila ito. So another process siya. Dadaan ito sa Register of Deeds pa etc. So I am sorry I can not say how long this will take.

Hi Miriam. We are currently planning to sell my wife's car. She acquired her car thru her previous company/employer. She was a med rep before and as part of her separation package the vehicle was offered to her and the price of the vehicle was deducted to her separation package.

My question is:
1. Her company only sent her the following documents:
a. Deed of Sale
b. Original OR/CR.

In your post you stated that it is required to have "Release of Chattel Mortgage" from the bank. Did the company missed to send that document to her? Or the Deed of Sale is also the "Release of Chattel Mortgage"?

Thanks in advance for answering.

Miriam Barredo said...

Hi Richard,
If the original LTO CR given to you does not have the words "Encumbered" on it, then, you do not need a "Release of Chattel Mortgage". The LTO CR you have is clean. Parang sa titulo sa lupa - clean title. Hindi po siya naka sangla.
Best regards,

Miriam Barredo said...

Anonymous, maybe you should try going to the bank that issued the Promissory Note and request for a copy. Make an Affidavit of Lost Promissory Note and have it notarized. Present the copy of the Promissory Note and the Affidavit of Lost to the R.O.D,

You can also return to the Register of Deeds and tell them of your problem /situation. They are better equipped to advise you.

Regards

Miriam Barredo said...

To date most banks have incorporated their Chattel Mortgage and Promissory Note into 1 document. Check if the one you have is one such document.

Miriam Barredo said...

Hi Ark! You should have renewed your LTO Registration at the LTO Agency where you need to have your LTO CR Unencumbered. That way the 2 procedures would have been combined in one LTO Agency and you would not have the small dilemma you are in now.
Anyway, since there is no hurry to having the LTO CR Unencumbered and you have renewed your LTO Registration at a different LTO Agency already, you just need to wait for your LTO stickers to be issued. After this, then you go to the LTO Agency where you need to have your LTO CR Unencumbered.

Hello Batmae, you can request a copy of the LTO CR from the bank where your unit is encumbered. You can call the bank first before going to them so they can have your copy on hand for you when you go to them. The contact numbers of some of the major banks are listed in this blog. Regards

Hello Mr. Melvin Carpio, you need to go to The Head Office of RCBC Savings Bank in Ortigas Center to get the Release of Chattel Mortgage of the unit. Aside from the authorization letter you also need to present a copy of Dr. Chua's valid govt't issued ID. There is a minimal fee to be paid. After you receive the release of Chattel Mortgage and other docs, you can proceed to the Register of Deeds in the city indicated in his address in the LTO CR for the Cancellation of Chattel Mortgage. There is also a fee to be paid here. For more information please re read my blog. Best regards,

Hello Ms Miriam,

We bought a car in 2008, we assumed the balance, now that that it is already paidoff, we went to PSBANK Main branch to claim the release of chattel mortgage, However, PSBANK refused to accept the authorization given to us due to some erasures which we did not notice before, we have no idea where the original owner is right now, but we have the authorization, copies of his govt IDs, what do you think shall we do in order to get the papers from the bank so we can sell the car? Thanks for your help

Thanks po, Hope to hear from you soon. God Bless.. at more power po sa Blog nyo

Miriam Barredo said...

Nakalagay po sa mga auto loan documents na "without need of demand" yun pagbayad ng monthly amortizations and yearly renewal and submission of bank copy of insurance policy. Kaya wala kang matatanggap na notice from the bank. It is your responsibility to do these things automatically po. Kaya pag nag expire na yun insurance policy at di ka pa naka pag provide ng copy ng renewed insurance policy, the bank will get a new insurance policy. The insurance premium will be charged to you.

It is only the LTO OR that changes whenever you renew your LTO Registration. Best regards

Hi Ms. Miriam, your blog is very informative. My question po ako regarding sa brand new Honda vehicle that my father and I purchase thru in-house financing assigned to Bdo 4 years ago. My dad bought it for me, but he was the registered owner and my wife and I was his co-maker/borrower because he was over 65 at that time. Unfortunately my dad
passed away after 4 months. After his death, I decided to just pay the mortgage in full. Ngayun ko pa lng po kukunin yung securities po nung loan, kailangan pa po ba iinform yung Honda and can I get those documents sa bank myself kahit Hindi ako yung registered owner? Thank you in advance!

Miriam Barredo said...

@Miya you can only have the CR Unencumbered at the LTO Agency that Encumbered the CR. Pls do not believe online fixers saying that they can do this for a fee. You will only be scammed.

Cause im planning to sell the car and its taking too long because the first owner refuses to make a new deed of sale..pls reply really need your advice

Miriam Barredo said...

Where's the owner that you bought the unit from? He should be the one to approach the original owner for the requirements, po. The first owner does not know you so he is hesitant to give you a copy of he deed of sale and his ID. Protocol dictates that the 2nd owner (the one who you bought or unit from) must provide you with the necessary documents.

@Rhea Bilaro the factors that affect the cost of Chattel mortgage fees are - total amount financed with the interest, place of residence etc. I am sorry but I do not know of any clear cut formula for getting the cost of the chattel mortgage. Hi Ms. Miriam,

I am in the process of restructuring lost release chattel mortgage. The release chattel mortgage was furnished by a person. The CR states encumbered to "name of the person".

What I do have is a photocopy of the release mortgage but the notarial registry part is barely readable. I Have tried securing a 2nd release mortgage but the office of the person to whom it was encumbered before is already closed.

My question is, does the Registry of Deeds of the place of residence of the registered owner the one with jurisdiction on canceling the mortgage? If such, do they keep copies of the release mortgage and could I request a copy from them?

If not, what do I need to do to be issued a clean CR? Thank you in advance :)

Hello Ms. Miriam, my sister have lost all her vehicle's documents except for a copy of CR and the latest registration. She has fully paid it since 2011 but have not yet unencumbered. However, she has left the Country and asked me to take care of the necessary to request for the copies of the lost documents. I have requested from the bank for a copy of PNCM, but they said they require certified true copy of the PNCM which I can get from RoD or LTO. RoD said I may request from LTO since all the docs are there. But LTO says I need to get a copy of PNCM from the bank so they can issue the documents I need. I am very confused, which office should I go. I do not know where to start and what to do. I am hoping you can give me some clarifications on this issue. Thank you.

ROD is only suppose to give youthe Cancellation of Chattel Mortgage after you give them a copy of the Encumbered LTO CR and Release of Chattel Mortgage issued by the bank. Then submit the original encumbered LTO CR and latest CR with.the Cancellation of Chattel Mortgage etc to the LTO agency that issued the encumbered LTO CR so that they can change it to a new unencumbered CR.

So this mean i will go to Union bank for the releaase of chattel mortgage. when I go to LTO, just to clarify, on my last renewal of the OR and when I got a copy of my CR (as i lost the copy i had), they issued me a CR that has no more note of Encumbered. Do I still need to go to LTO where it was first registerd to submit the Release of Chattel Mortgage? I am not sure if there was just a mistake of LTO Muntinlupa to issue me a copy of a CR when i applied forit last time without the ENCUMBERED tag on it.

Kindly help.

Where will i go from my current situation, looking forward for your prompt reply. Thank you.

Please check the original LTO CR you have on hand. If there is no word "Encumbered" on it then you already have a clean LTO Certificate of Registration. No need to go through the process of having it unencumbered because it is no longer encumbered. Best regards,

Hi Miriam,
Just want to ask po regarding insurance for the car loaned in bank.

One of the agreements of the auto loan is that the borrower must provide a Comprehensive Insurance Coverage for the unit for as long as the the auto loan is still active. If you fail to provide one, the bank will get one and the insurance premium will be charged to the you, the borrower.

Hello all those who have an auto loan, part of the auto loan documents you signed is the Promissory Note that states your monthly amortization amount and due date. As such, do not expect to receive notice reminders from the bank, as it is your obligation to pay your monthly amortizations on or before due date. It is the same with your obligation to provide a yearly comprehensive insurance coverage for your unit. You are responsible for providing the comprehensive insurance coverage with or without a reminder from the bank. Best regards,

Hello Maam,

thank you for this helpful blog. May question po ako and I need an advice. May binili kasi akong car last year sa dati kog officemate. I paid in full pero yung binigay lang nyang CR is photocopy then later na namin na notice na encumbered pala sa isang credit firm. kinausap ko sya na bayaran na nya yung utang nya sa credit firm para ma release na yung CR. kasalanan ko rin kasi nag trust ako sa kanya kasi nga kaibibigan. ang tanong ko kung sakali hindi nya mabayaran yun,macha-charge ba kami or something? baka kasi e-delare na ninakaw namin o kaya biglang di na kami maka-renew sa LTO or kaya bigla nalang kaming e-stop at kunin yung sasakyan. Please advise.

Hi Mam Miriam,

May auto loan po ako sa BDO contract is 3 years. Naka 5 months palang ako. Pwede ko po ba ipa-assume sa iba yung remaining balance? Meaning ibenta ko po.

How it should be done, dadalahin ko po ba yunv buyer sa BDO? O contract to sell nalang, tapusin nalang namin payment then ilipat namin sa name nya once fully paid na.

Thanks in advance. More power!

Hi Miriam!

Thank you for this article.
Three years ago, I acquired an auto loan through BDO in Manila.
After two years, I decided to move back to Zamboanga, and had the car shipped here. Now, I am two months shy of completing my auto loan payments and reading through your blog post, it looks like I need to have the car sent back to Manila to process the papers. Sending the car back and forth is costly, and I was wondering if there's a way I can do all that without having to send the car back to Manila and then back to Zamboanga again.

Thanks in advance for your help.

Raia

Miriam Barredo said...

@Raia Hello! You do not have to send your car back. Where was your auto loan? You can approach the branch of the bank where you had your auto loan. They can request that the original LTO OR CR and Release of Chattel Mortgage be sent to that branch for you to pick up. After you have received these, you can go to the Register of Deeds in your area to get your Cancellation of Chattel Mortgage. Once, you have the Cancellation of Chattel Mortgage. You can contact your car dealer to assist you in the removal of Encumbrance in your LTO CR. They will need the LTO Stencils of your car's engine & chassis. Ask them for assistance and how much the process will cost. Best regards,

i bought a car that was previously encumbered. cancellation of mortgage has been filed correctly. but upon filing to LTO the cancellation of encumbrance and transfer of ownership, they are requiring release waiver and quitclaim from the mortgagee. is that really a requirement? it is not even stated in LTO's website. thanks.

@Joan Co pls bring
1) Cancellation of Chattel Mortgage
2) stencils of Engine & Chassis
3) notarized deed of sale (if transfer of ownership)
4). PNP clearance
5). The LTO CR with latest LTO OR

How long does it take to get the Cancellation of Chattel Mortgage?
It depends on the ROD. At the Antipolo ROD it took 4 hours. At the Mandaluyong ROD it took us less than an hour. However, at the QC ROD, they told us to return after 7 working days. It would be best that you ask the ROD concerned how long it would take. Do this at the actual time you submit your Release of Chattel Mortgage docs that your bank gave you.

How long does it takes for a bank to issue car insurance policy, amortization schedule copy, permanent plate number & OR/CR photocopy? The car just purchased and released last July 25 2014 thru RCBC auto loan.

Pwede po bang Authorization ko nalang kahit di galing sa philippine consulate. But notarize by a lawyer, mahal po kasi ng bayad at wala po ako time makapunta dun.

Good noon miss Miriam Barredo.

what you doing here it really really helps!!!
It is good to know na may mapag katiwalaan....
By the way my problem is that we bought our car from cebu last 2011 and we are now in Manila. My parents in cebu has already got the documents from the bank and also already been to the register of deeds. So now Lto need to have the car inspection so they can give us the unencumbered CR, but how? if our car is here in manila? Thanks for taking the time?

Miriam Barredo said...

@Anonymous , you could approach the car dealer where you bought your car from for assistance at that stage.

Anonymous said...

@jackie: you can have your car inspected by an LTO branch in manila, after the inspection, get the MVIR (inspection report) and OR, attached those with the documents released to you by the bank. This process will eliminate the need to bring your car in cebu. I've done this last month.

By the way, you need to go first the registry of deeds where you filed your Promissory note/ mortgage to have it cancelled, you need to present the release of mortgage to do this.

Miriam Barredo said...

@Anonymous thank you for your suggestion to @Jackie.
